2024-08-01 | The question relates to the rights and obligations of the lead and members of the joint venture (JV). If the product distribution permit belongs to a member of the JV, can the lead partner import the product using the distribution permit of the JV member? Thank you. | Thank you for your question. In a joint venture (JV), the rights and obligations of the lead partner and other members are governed by the terms of the JV agreement. If the product distribution permit is held by a member of the JV, the lead partner can typically import the product using that distribution permit, provided that this arrangement is explicitly allowed under the JV agreement and complies with relevant regulatory requirements. It is essential to ensure that all actions taken align with the legal framework and the terms agreed upon by all JV partners.Refer to GCCC 6.1 all of the JV parties shall be jointly and severally liable to the Purchaser for the fulfillment of the provisions of the Contract and shall designate one party to act as a leader with authority to bind the JV. | Bidding procedure | Procurement Regulations | Eligible Bidders (including joint venture)

2024-08-02 | Criteria: face mask neo (100 Pc) Remarks: Can a face mask be replaced with a nasal mask? For neonatal patients, nasal masks are often used so that the mouth area remains open, allowing for the continued administration of breast milk. | Many thanks for this feedback. Upon consideration, MoH has decided to retain the current specification. Bidder to provide a minimum requirement stated in the bidding document. | Bidding procedure | Evaluation Process | Technical Evaluation
2024-08-02 | Criteria: Volume Control Ventilation (VCV) Mode (Required; Bidder to specify full list of VC modes, or equivalents) & Volume Synchronized Intermittent Mandatory Ventilation (VSIMV) (Required; Bidder to specify full list of VSIMV modes, or equivalents) Remarks: Clinically, neonatologists always use pressure mode because it has been proven to be safer for infant and pediatric patients. Please review the requirement for the inclusion of volume mode. | Many thanks for this feedback. MoH considered this request and will remove the Volume Control Ventilation (VCV) and Volume Synchronized Intermittent Mandatory: Ventilation (VSIMV) modes requirement from the specification in an upcoming amendment. | Bidding procedure | Evaluation Process | Technical Evaluation
2024-08-02 | Criteria: BPAP Remarks we would like to reference whether it could be added with ""or equivalent,"" because the BPAP mode is a mandatory ventilation mode from the Ventilator machine to patients who cannot breathe spontaneously, and there are several ventilation modes that function similarly to BPAP, such as SIMV. | Many thanks for this feedback. Upon further review, MoH has determined that the specification is not restrictive, and has therefore decided to retain the original specification. | Bidding procedure | Evaluation Process | Technical Evaluation
2024-08-02 | Criteria: High Respiratory Rate Alarm, Remarks: we believe this alarm mode directs towards a particular brand, and if we may suggest, this alarm mode could be removed or not made a mandatory specification. | Many thanks for this feedback. Upon further review, MoH has determined that the specification is not restrictive, and has therefore decided to retain the original specification. | Bidding procedure | Evaluation Process | Technical Evaluation
2024-08-02 | Criteria: the Loss PEEP alarm, Remarks: we believe this alarm mode directs towards a particular brand, and if we may suggest, this alarm mode could be removed or not made a mandatory specification. | Many thanks for this feedback. | 17 | 2024-08-02 | Criteria: Vent Inoperative alarm, Remarks: we believe this alarm mode directs towards a particular brand, and if we may suggest, this alarm mode could be removed or not made a mandatory specification. The Ventilator Inoperative alarm can be replaced by, for instance, a Power Fallure Alarm or Self-Calibration indicator, which if failed, would automatically render the Ventilator unit unfit for use. | Many thanks for this feedback. Upon further review, MoH has determined that the specification is not restrictive, and has therefore decided to retain the original specification. | Bidding procedure | Evaluation Process | Technical Evaluation
2024-08-02 | Criteria: Pressure Ramp Feature (Required, to allow incremental increase of pressure to the final prescribed level over a period of time & Ramp time range, min (at least 0-15 minute), Remarks: What is meant by Pressure Ramp and what is the purpose and function of this feature? | This question is similar to the previous question #70. (at least 0-15 minute) Remarks: What is meant by Pressure Ramp and what is its purpose and function? | Many thanks for this feedback. The pressure ramp feature in a non-invasive ventilator helps patients ease into using the device by starting at a lower pressure. As they begin, the ventilator delivers air at a lower pressure, making the adjustment process more comfortable. Gradually, over a set period of time (adjustable ramp time), the air pressure increases until it reaches the target pressure. | Bidding procedure | Evaluation Process | Technical Evaluation
2024-08-02 | Criteria: Reused Expiratory AIR Filter (3pcs) Remarks: It is a standard that accessories for infant ventilators should be disposable. Relevant documentation is acceptable provided that it clearly demonstrates the bidder's experience in managing cyber security, practice and track record, including relevant Cyber security accreditation such as ISO 27000 (ISO 27001) or equivalent (if any), therefore, using the certificate of principal is allowed. The bidder is also requested to provide relevant equipment cybersecurity mitigation via their MDS2 Form in the bid. | Bidding procedure | Procurement Regulations | Forms

MoH has considered this request, and will update this specification in a forthcoming amendment. | Bidding procedure | Evaluation Process | Technical Evaluation |
2024-08-02 | Criteria: Alarm Priority/Level, Remarks: wouldn't it be better to remove the Critical alarm level considering there is already a High alarm level that is just as important as the Critical alarm? | Many thanks for this feedback. MoH has considered this request and will update this specification to ""High, Medium, Low"" in a forthcoming amendment | Bidding procedure | Evaluation Process | Technical Evaluation
| 31 | 2024-08-02 | Criteria: Inverse I:E Ratio Alarm, Remarks the Inverse IE mode is never used as a benchmark or alarm indicator on Ventilators. | 153 | 2024-08-28 | Q1: MOH said that ""bidders are free to determine which entity is responsible for importing Goods procured the current tender, including joint venture members and subcontractors. However, facilities on import taxes, VAT, and other customs duties, which are projected to be granted for Goods to be imported into Indonesia as part of current project are projected to be, shall only apply to the main contractor. In the case of IV, this would this include IV partners. Subcontractor will, by contrasts, not be able to benefit from these facilities. We are a foreigner company, the product we are gonna submit has been registered in Indonesia, but the license holder is a local / Indonesian company. As far as we understand, only the license holder can do the import/customs clearance (pis correct us if it is wrong). In this case, it seems for those product which has been registered in Indonesia before the date of award of contract or deadline of bid submission, international companies must form a JV with an Indonesian company, otherwise the V can not get the tax exemption. If so, it is unreasonable. Is it possible that MOH can exempt the tax for the JV, whom is not the license holder? Thank you. | Many thanks for the question. As specified in the relevant Bidding Document, the possession of a Nomor Izin Edar (NIE, Distribution Permit Number shall not be a pre-condition for the bidders to participate in the bidding process and shall not be the basis for rejection. In the event that a successful Bidder does not possess a NIE, they will be offered an accelerated track for registration before contract signing. Facilities on import taxes, VAT, and other customs duties, which are projected to be granted for Goods to be imported into Indonesia as part of current project shall remain limited to the bidder either as sole bidder or joint venture, in the case of IV, this would include IV partners.
