We acknowledge receipt of your email dated August 6 and 14, 2024, and have carefully reviewed your request to remove the IsDB Boycott regulation from the bidding document. The IsDB is governed by the policies and principles agreed upon by its member countries, many of which are members of the Organization of Islamic Cooperation (OIC). Consequently, the IsDB Boycott regulation is a mandatory inclusion in our Procurement Guidelines and all related bidding documents. Procurement under the project shall be carried out in accordance with IsDB’s Procurement Policy and Procedures through provisions contained in the IsDB’s (i) Guidelines for the Procurement of Goods, Works and Related Services under IsDB Project Financing (April 2019 edition, revised in February 2023) and (ii) Guidelines for the Procurement of Consultants Services under IsDB Project Financing (April 2019 edition, revised in February 2023). Core procurement principles of the IsDB shall be respected throughout all procurement transactions. According to: • Paragraph 1.8.1 of the Procurement Guidelines, it is a fundamental policy of IsDB that the Request for Bids (RFB) shall unequivocally stipulate that the Goods, Works and/or Related Services provided by the Contractor, and its associates and sub-contractors, shall be in strict compliance with the Boycott Regulations of the Organization of the Islamic Cooperation, the League of Arab States, and the African Union (Boycott Regulations). The Beneficiary shall advise prospective Bidders that Bids will only be considered from Firms that are not subject to these Boycott Regulations. We acknowledge receipt of your email dated August 6 and 14, 2024, and have carefully reviewed your request to remove the IsDB Boycott regulation from the bidding document. The IsDB is governed by the policies and principles agreed upon by its member countries, many of which are members of the Organization of Islamic Cooperation (OIC). Consequently, the IsDB Boycott regulation is a mandatory inclusion in our Procurement Guidelines and all related bidding documents. Procurement under the project shall be carried out in accordance with IsDB’s Procurement Policy and Procedures through provisions contained in the IsDB’s (i) Guidelines for the Procurement of Goods, Works and Related Services under IsDB Project Financing (April 2019 edition, revised in February 2023) and (ii) Guidelines for the Procurement of Consultants Services under IsDB Project Financing (April 2019 edition, revised in February 2023). Based on Government Regulation No. 42/1995 as amended by Government Regulation No. 25/2001, procurement that is financed from government loan are to be exempted from taxes which comprises of duty import, VAT, and income tax. Moreover based on Act No. 17/2006 about Duties and Ministry of Finance Decree No 171/2019: Government provides facilities of duty free for imported Goods that are intended for public purposes (non- tradeable). The Special Conditions of Contract (SCC) are intended to provide additional details and modifications to the General Conditions of Contract (GCC), ensuring that both sections work in conjunction to clarify the terms of the contract. The clause on liquidated damages in SCC 27.1 addresses delays in delivering the Goods by the agreed delivery dates, whereas penalties under SCC 27.2 pertain to the performance of the contract after the goods have been delivered and installed. Regarding the terms "Unitary Contract Value" and "Value of the Delayed Part of the Equipment," these refer to distinct concepts and therefore cannot be interchanged. To clarify, the liquidated damages of "1/1000 per day" mean that for each day of delay, a charge equivalent to 0.1% of the Unitary Contract Value of the delayed part of the equipment will be imposed. While the reference date is listed as December 2024, this is not a fixed requirement—it's merely an indicative date. List of Goods and Delivery Schedule) which is more reflective of the end of the RFB process for delivering the systems? i.e. delivery starting from 2025 until December 2026. Additionally, we would appreciate MOH to please inform us early/upfront the communication/mechanism in which quarter of each year the equipment will be required for each hospital listed in the contract document, the relative timing of the notifications and how this will interact with the 210-day window for equipment delivery, when exactly would the Services be required relative to equipment delivery, and when/what exactly the scope of room readiness works will be defined for each location in comparison to the notification issued for that equipment. |
As described in the bidding documents, the MoH continuously tracks facility readiness based on four readiness criteria: (i) prior availability of equipment in the facility; (ii) human resource capacity; (iii) infrastructure and utility access; and (iv) adherence to local and national regulations on medical waste. At least on an annual basis, MoH will provide a list of facilities meeting readiness criteria where equipment can be installed, for a period of up to four years from contract signing. Upon completion of due verification processes of these readiness criteria, MoH will provide the supplier with a written advance notice of the locations that meet all readiness criteria and are therefore ready to receive the equipment. These facilities are expected to be included in the subsequent delivery of equipment by the supplier, with room readiness and pre-installation services, delivery, installation, testing, and commissioning to be completed within 210 days from this notification. |

Thank you for your question. Suppliers are required to ensure a minimum average of 95 percent uptime across all fully commissioned equipment, calculated over a six- monthly period. Failure to do so will result in recourse to contractual remedies. These remedies are meant to ensure that performance standards are met and to provide additional recourse beyond the standard penalties. For detailed contractual remedies will be discused further with the successful bidder. |
