Section I – Instructions to Bidders (ITB), ITB 14.5 – page 16 Prices quoted by the Bidder shall be fixed during the Bidder’s performance of the Contract and not subject to variation on any account, unless otherwise specified in the BDS. A Bid submited with an adjustable price quota on shall be treated as nonresponsive and shall be rejected, pursuant to ITB 31. However, if in accordance with the BDS, prices quoted by the Bidder shall be subject to adjustment during the performance of the Contract, a Bid submited with a fixed price. Bidder would like to clarify whether the pricing specified in ITB 14.5 can be floating? For example, USD 10,000 for the first 1-2 years, USD 12,500 for year 3-4. The reason for this inquiry is the fluctuating economic conditions in Indonesia in relation to the US dollar. As an illustration, the exchange rate of the Indonesian Rupiah to the US dollar five years ago was approximately IDR 14,100 to USD 1, whereas it is now around IDR 16,000 to USD 1. |
Thank you for the question. As per provision ITB 14.5, the price of each Unit (Goods) cannot be floating as per your example. Prices charged by the Supplier for the Goods supplied and the Related Services performed under the Contract shall not vary from the prices quoted by the Supplier in its Bid, and these are fixed, unified prices per unit for each lot, and applicable for the duration of the contract. The unitary contract price is therefore fixed regardless of the year of order or installation during the full contract period. Prices can be quoted in three foreign currencies in addition to Indonesian Rupiah, with the exchange rate set at the date on the date of bid submission deadline, as per ITB 36.1. | Bidding Procedure | Procurement Regulations | Procurement Methodology |

Clause Reference in Tender Document: Technical Specification for Heart Lung Bypass Row 105: Fluid temperature range: 0-43. Clarificaion / Propose for Revision: To ensure proper clinical function in the technical specification, Bidder suggest a review to this requirement that says 0 degree due to the requirement is clinically not possible because water freeze at 0 degrees, hence there will be no flow. The low temperature should be maintained start from 2 degrees or instead of 0-43, the statement is made “to up to 43 degree” |

| 63 | 2024-08-29 | Hi,we heard that we can still do refutation until today 29 August 2024, and we sil have some question left for each HLM & ECMO machine, which is: Heart Lung Machine -A96 Minimum No. Of FLuid Reservoirs,it was mandatory to have at least 2 tanks. Question : Could it be subtitute with 2 Heater Cooler consist with 1 tank each?, it wil be smaller size, and If put together side by side, it was even smaller width and height if compare to Heater cooler with 2 tanks |
If both heater coolers are completely integrated into the Heart Lung Machine (in parallel), the proposal could be considered equivalent to the required specification | Supply Requirements | Evaluation Process | Technical Evaluation |
| 64 | 2024-08-29 | "We refer to the last Addendum of Technical Specifications and Bidding Document for the Procurement of Surgery Equipment Lot 2 - Procurement of ECMO Set and Lot 3- Procurement of ECMO Set (NICU) dated August 22nd, 2024. After checking the technical specification file, we have noted that a number of specifications remain rather problematic. Besides, some items falls into pharmaceutical products which could create some license issue for the bidders. Please find herein after our detailed review followed by some suggestions: B. TECHNICAL SPECIFICATION - Row 111, 112, 116, 118, 120, 125 & 135 The specifications related to the Heater unit of the ECMO seem mixed up with specifications that would relate more to a Heart and Lung machine that requires a Heater-Cooler unit rather than an ECMO unit that uses only a Warmer. This “confusion” is found in a number of requirements as detailed herein below: 1. AII ECMO applications require only the features of Warmer unit to keep / maintain the patient temperature around 35 - 39°C while undergoing ECMO therapy. 2. There is no need of any cooling feature as the patient temperature remain steady: no heating is required as well: only warming. 3. A warmer unit is much smaller than a heater cooler unit and this is exactly what is required as an ECMO must be portable to allow patient evacuation. 4. Because of the above, a number of requirements in the bidding documents specifications that refer to Heater Cooler and not Warmer unit are therefore not applicable, namely: - “at least 2 Fluid Reservoirs” 1 is enough, - “Capacity, L (gal) at least 2 liters” 1 to 1,5 is enough, - "more than 2 Connectors” 2 are enough, - “Cooling Method: Build-in Compressor-based (Mandatory)" is not applicable. 5. The definition in row 111 must also be clarifed: the ECMO unit must be compact unit in its evacuation configuration without wheels attached: the wheels shall be on the trolley and the unit shall be able to be detachable from the trolley for the evacuation cases. |
Many thanks for this feedback. MoH has considered this request and will revise the technical specification for the ECMO sets in a forthcoming amendment. | Supply Requirements | Evaluation Process | Technical Evaluation |

After checking the technical specification file, we have noted that a number of specifications remain rather problematic. Besides, some items falls into pharmaceutical products which could create some license issue for the bidders. Please find herein afer our detailed review followed by some suggestons: A. TECHNICAL SPECIFICATIONS - Row 64 The priming volume of the ECMO is required to be less than 200ml. Our opinion is that it should be opened up to a range of 150 to 250 ml because: 1. It would allow more companies to offer their products, 2. Some products (including ours) have very good results for paediatric patients with a priming volume a bit higher than 200ml. 3. We understand that Neonate patients require lower volume but also other additional features as included in the other ECMO lot (lot 3) exclusively dedicated to Neonate patient. |
Many thanks for this feedback. Upon consideration, MoH has decided to retain the current specification. Please bidder to provide a minimum requirement stated in the bidding document. | Supply Requirements | Evaluation Process | Technical Evaluation |

After checking the technical specification file, we have noted that a number of specifications remain rather problematic. Besides, some items falls into pharmaceutical products which could create some license issue for the bidders. Please find herein after our detailed review followed by some suggestions: C. Start-up sets We have noticed that included in the start-up set required for ECMO in the procurement specifications are mentioned “Albumin & Heparin” which are pharmaceutical drugs. We understand that indeed these drugs are used during the ECMO therapy but it is usually provided by hospital pharmacy in quality and quantity under their responsibility and procured from pharmaceutical distributors duly licensed to handle pharmaceutical products. Can you confrm that you wish a distributor of medical equipment to supply those pharmaceuticals and clarify how to proceed in relation with necessary license to handle Pharmaceuticals? |
