3 2024-08-21 While the RFB specifies Payment Terms in Section IX - Special Conditions of Contract 16.1, it is unclear how the payments beyond the 10% advance payment and the 25% onshipment payment (made via letter of credit) will be guaranteed.

35% Acceptance Payment: How will the 35% payment milestone upon acceptance, testing, commissioning, and training (as per SCC 16.1) be guaranteed to the supplier? 30% Uptime Performance Linked Payments: How will the cumulative 50% payment based on up-time performance over four years be guaranteed to the supplier?
Thank you for your question. The payment milestones, including the 35% upon acceptance, testing, commissioning, and training, as well as the 30% linked to uptime performance over 2 (two) years, are secured under the terms of the contract with the Ministry of Health (MoH). The MoH will be responsible for ensuring that these payments are made as per the agreed schedule in the Special Conditions of Contract (SCC 16.1). The guarantees for these payments are embedded in the contract, and the MoH, as the contracting authority, is committed to fulfilling its financial obligations as stipulated. We kindly request detailed explanation of the payment guarantee mechanisms for these milestones and clarification on the responsible payer(s) to ensure a clear understanding of the financial process and minimize potential risks for the supplier.
The Ministry of Health (MoH) is responsible for managing the payment process according to the milestones defined in the contract, ensuring that all payments are processed in a timely and secure manner. At the request of the MoH and the Ministry of Finance (MoF), the Islamic Development Bank (IsDB) makes a direct payment to the designated supplier, in accordance with the relevant terms and conditions of the underlying agreement between the MoH and the third party approved by the IsDB.

We all understand that the terminology associated with CT Physics is either Acquisition Slice (which is true slice data acquired from the patient anatomy) or Reconstructed slice (where we use computers to manipulate the acquired data set, further The computer system puts in plastic images in between every slices to make it a higher number of slices than actual). The word equivalent will help the vendors to offer an extremely low end CT scanners (8, 16 or 36 slice). Since the equivalent 64 slice is not actual 64 slice CT, hence the clinical outcome of these CT will be very limited compared to the actual/true 64 slice CT Scanner.

Which will eventually dilute or lower the clinical confidence & capability of the department.
-And the purpose of procuring a current generation CT scanner will be defeated.

For all the CT Lots, I found it required that,

*Number of Laser Printer 1

As I understand, this should be a laser printer for films. Please correct me if any mistake.
And also required

*Laser Printer Toner - Bidder to supply quantity for 100 typical patient procedured

I think this is the same printer as mentioned above.
But per my understanding, toner should be a thing used in the paper printer, not in film laser printer.
I guess maybe it requires films for 100 patients. or anything else?

What is the documents that we need to provide for the 3rd party (not the same brand/manufacturer as main unit) accessories and consumables? Does a Manufacturer Authorization required?
In the event that the bidder is a JV and submits a bid for accessories that are not manufactured by any of the JV members, a Manufacturer's Authorization is not required. However, if the primary equipment is not manufactured by any of the JV members, a Manufacturer's
Authorization will be necessary. The bidder is requested to fill in the price schedules according to the offered Goods (manufactured outside Purchaser Country-to be imported or already imported or manufactured in the Purchaser Country). Therefore, for any single lot bid,
more than one price schedules can be filled-in depending on the source of the Goods offered.

Registration of goods based on the Nomor Izin Edar (NIE, Distribution Permit Number) is required for equipment according to the Minister of Health regulation No.62/2017. However, this shall not be a pre-condition for the bidders to participate in the bidding process and shall not be the basis for rejection. Successful bidders will be offered an accelerated track for NIE registration before contract signing. If at the moment of submission, the NIE is not held by any of the JV members, but is transferred to one of the JV members after the contract is signed, does the bidder need to provide the NIE or is another registration license acceptable for submission?

The GCC/SCC seems to mention several different penalty reference values (“Unitary Contract Value” vs. “Value of the Delayed Part of the Equipment”). We recommend to use the common term of “Unitary Contract Value of the Delayed Part of the Equipment only” in all cases in view of the total contract value. May we therefore please ask MOH to clarify the penalty rate and upper limit specifically as referenced in 27.1 of the SCC, i.e. with the reference to the phrasing of “1/1000 per day” and “10% of the Unitary Contract Value”?

The Special Conditions of Contract (SCC) are intended to provide additional details and modifications to the General Conditions of Contract (GCC), ensuring that both sections work in conjunction to clarify the terms of the contract. The clause on liquidated damages in SCC 27.1 addresses delays in delivering the Goods by the agreed delivery dates, whereas penalties under SCC 27.2 pertain to the performance of the contract after the goods have been delivered and installed.

Regarding the terms "Unitary Contract Value" and "Value of the Delayed Part of the Equipment," these refer to distinct concepts and therefore cannot be interchanged.

As specified in the relevant bidding documents, penalties will be applied due to delays in repair, full commissioning, preventative maintenance, and corrective maintenance during the extended warranty and service contract periods.

In the case of the CT Scan tender, the penalties related to delayed downtime will be 0.1% of the Unitary Contract Value of the affected quantity per day after 5 days from the notification. The penalty will be increased to 0.3% of the Unitary Contract Value of the quantity that continues to experience delays in downtime, per day from the 16th day. The maximum penalty during the Operational support and Maintenance phase, upon acceptance, will not exceed 25% of the Unitary Contract Value for the entire lot.

In addition, failure to ensure a minimum average of 95% uptime, calculated across all fully commissioned equipment over a 6 monthly period, will result in recourse to contractual remedies.

It is highly uncommon for hospitals to own CTDI Phantom as it is rarely needed after the system is handed over to the hospital. Should it be required at any moment after the system handover, hospitals can have access to CTDI Phantom through the standard maintenance services that the supplier will provide at least 2 times per year over the course of the warranty period, as specified in the bidding documents. Unlike CTDI Phantoms, Image Quality Phantoms are typically supplied as part of the CT system and permanently stay at the hospitals for regular system performance checks.
