| 4 | 2024-11-05 | Dear Tim Pokja, We, PT. XXXX, would like to inquire about several matters related to the Procurement of Cytotoxic Drug Safety Cabinet. Our questions are as follows: 1. If the factory/manufacturer involved in the joint venture (JV) is from a country that is not an IsDB Member Country, can they still participate in the procurement and form a JV with a company that will participate in the procurement? Thank you for your attention and guidance. We look forward to your response. Best regards, |
Thank you for your question. Bidder shall provide information that the they are not subject to Boycott Regulations and no other information is needed. The IsDB is governed by the policies and principles agreed upon by its member countries, many of which are members of the Organization of Islamic Cooperation (OIC). Consequently, the IsDB Boycott regulation is a mandatory inclusion in our Procurement Guidelines and all related bidding documents. Procurement under the project shall be carried out in accordance with IsDB’s Procurement Policy and Procedures through provisions contained in the IsDB’s (i) Guidelines for the Procurement of Goods, Works and Related Services under IsDB Project Financing (April 2019 edition, revised in February 2023) and (ii) Guidelines for the Procurement of Consultants Services under IsDB Project Financing (April 2019 edition, revised in February 2023). Core procurement principles of the IsDB shall be respected throughout all procurement transactions. According to: • Paragraph 1.8.1 of the Procurement Guidelines, it is a fundamental policy of IsDB that the Request for Bids (RFB) shall unequivocally stipulate that the Goods, Works and/or Related Services provided by the Contractor, and its associates and sub- contractors, shall be in strict compliance with the Boycott Regulations of the Organization of the Islamic Cooperation, the League of Arab States, and the African Union (Boycott Regulations). The Beneficiary shall advise prospective Bidders that Bids will only be considered from Firms that are not subject to these Boycott Regulations. The Bidder shall provide a letter of oath to that effect. • Resolution 1/49-IBO on Islamic Office for the Boycott of Israel, point #1, Recalls the Jakarta Declaration on Palestine and Al-Quds Ash-Sharif, adopted during the Fifth Extraordinary Islamic Summit on Palestine and Al-Quds Ash-Sharif on 7 March 2016, containing commitments to pursue concrete actions to be collectively taken towards the realization of the inalienable rights of the Palestine People, including calls upon the international community to support the boycott of products produced in or by the illegal Israel settlement As an organization committed to ethical standards and complying with international regulations, the IsDB includes specific clauses in its bidding documents to align with these principles and legal obligations. The Boycott regulation is one such clause, reflecting our commitment to the policies and principles established by our member countries and governing bodies. The inclusion of the Boycott regulation is a standard practice in IsDB-financed projects and is not intended to disadvantage or discriminate against any potential bidder. Instead, it ensures that all participants in IsDB-funded projects comply with the established regulations that govern the procurement process. We understand that this may present certain challenges for bidders, but it is important to maintain the integrity and fairness of the procurement process by adhering to these regulations. Unfortunately, we are unable to accommodate your request to remove the IsDB Boycott regulation from the bidding document. |

| 5 | 2024-11-05 | Question 3: As the manufacturer, are we required to form a joint venture (JV) with a private Indonesian company to participate as a member in the JV collaboration? | Please refer to the respective response on the question #2. | Bidding Procedure | Procurement Regulations | Eligible Bidders (including joint venture) |
| 6 | 2024-11-05 | 2. If the factory/manufacturer does not join the JV, can the JV participant still utilize the experience and installed units of the factory/manufacturer? | A partner, distributor, or manufacturer’s experience cannot be used unless they are part of a Joint Venture (JV). If the minimum experience requirement cannot be met independently, vendors are allowed to form a JV consisting of up to three members. The minimum experience requirement must be supported by documentary evidence, such as copies of signed contracts and corresponding completion certificates. If any such contract contains a confidentiality or non-disclosure clause and the bidder is unable to provide a copy (as confirmed by a formal letter), alternative documentation acceptable to the Purchaser, such as a copy of a purchase order or delivery order, must be provided. With regard to specific experience, it refers to similar experience, including conducting installations. Bidders may include manufacturers, distributors, or sole agents, and they must demonstrate relevant experience through contracts or purchase orders. Such experience must fall within the relevant period specified in the bidding document. If a provider has not conducted installations, they may join a JV to meet this requirement. Proof of installation must fall within the scope of the bidder's own company. If the installation is outside the scope or experience of the bidder’s company, it cannot be considered as valid experience in conducting installations. |

| 22 | 2024-11-12 | 26.5 The Purchaser may require the Supplier to carry out any test and/or inspection not required by the Contract but deemed necessary to verify that the characteristics and performance of the Goods comply with the technical specification’s codes and standards under the Contract, provided that the Supplier’s reasonable costs and expenses incurred in the carrying out of such test and/or inspection shall be added to the Contract Price. Further, if such test and/or inspection impedes the progress of manufacturing and/or the Supplier’s performance of its other obligations under the Contract, due allowance will be made in respect of the Delivery Dates and Completion Dates and the other obligations so affected. What kind of additional tests are intended? To what extent additional tests are required, on page 161 (Special Conditions of the Contract) it is stated that there must be no additional costs |
Referring to SCC Clause 26.5 of the RFB, additional tests or inspections may be requested by the Purchaser to ensure the Goods comply with the technical specifications, codes, and standards. These tests typically include performance validation or compliance checks beyond the standard contractual requirements. The provision for no additional costs applies if the additional tests are necessary due to a deficiency in the Supplier’s initial performance. However, if such tests are outside the originally agreed scope and are deemed necessary by the Purchaser, reasonable costs incurred by the Supplier will be added to the Contract Price, as specified in SCC 26.5. Does this imply that no countries are excluded? | Eligibility criteria for participation, as stated in Section V (page 87) and ITB 4.3 of the RFB, depend on the absence of restrictions in the bidding document. Since no countries are listed as ineligible, there are no exclusions. However, bidders must still follow the funding agency’s procurement policies and comply with all relevant laws and regulations. | Bidding Procedure | Procurement Regulations | Eligible Bidders (including joint venture) |
| 25 | 2024-11-12 | How will the payment process work? After a 10% down payment, there is a 25% payment due after delivery and 35% payment due after acceptance, testing, commissioning, and training. However, since the delivery, acceptance, testing, commissioning, and training period extends over three years, can we arrange for payments to be made based on the completion of specific delivery milestones? | As outlined in Section IX - Special Conditions of Contract, Clause 16.2 of the RFB, the payment schedule is structured to align with specific delivery and performance milestones. For projects spanning multiple years, payments can typically be arranged in phases, corresponding to the completion of agreed-upon delivery milestones. Each milestone must include the delivery, acceptance, testing, commissioning, and training requirements outlined for the specific period. Coordination with the Purchaser to establish a detailed milestone-based payment plan during the contract negotiation phase is essential to ensure compliance with the contract terms. | Contract | Contract Management | Payment Term |

The costs incurred for such additional testing, if reasonable, can be added to the Contract Price. However, these charges are applicable only when the additional testing is beyond the bidder’s standards and the original contractual obligations. This ensures that any extra effort required by the Purchaser is fairly compensated, while standard obligations remain the bidder’s responsibility. | Contract | Contract Management | Contract |

ASPAK (Aplikasi Sarana, Prasarana, dan Alat Kesehatan) is the main source of data and the MoH’s facility-based information system on building, infrastructure, and equipment, triangulated with other health facility data from other reports and surveys such as Rifaskes 2019 and rapid primary data collection. Can you explain in more detail about the claims that must be supported by ASPAK? What does it mean that we have to be registered first with ASPAK? |
The claims process for uptime performance-linked payments, as referenced in SCC Clause 16.5 of the RFB, requires data validation through ASPAK (Aplikasi Sarana, Prasarana, dan Alat Kesehatan). This system serves as the Ministry of Health’s platform for monitoring infrastructure and equipment performance. To support a claim, bidders must ensure their equipment and performance data are accurately registered and updated in ASPAK. Registration with ASPAK ensures that all equipment is tracked within the system and allows triangulation with health facility data for performance validation. Claims submitted without ASPAK verification may not qualify for payment under the uptime performance-linked payment scheme. | Contract | Contract Management | Payment Term |
